Amendment to Title I Article 2, Chapter 3, Section 14 Section 2-2-3-14 of the Michiana Shores Municipal Code – Residential Siding Material

Whereas, the Indiana Codes, specifically IC-36-7-4-600 Series, empowers the Town of Michiana Shores to amend or partially repeal the text of its Municipal Code including its Zoning Ordinance;

Whereas, the residential area buildings in the Town of Michiana Shores must reflect the diversity required by the Town Code;

Whereas, in keeping with the intent of the code and the appearance of the community it is not the intent of this code to dictate what kind of siding materials must be used on the residential area buildings, but it is the intent of this code to indicate what kind of siding materials that may not be used in the residential areas of the Town of Michiana Shores

Now therefore, be it ordained as follows:

Title II, Article 2, Chapter 3, Section 14 – Residential Structure Siding Material – Siding materials shall be of a make and type that reflects the appearance of the community. No industrial/commercial type of metal or Fiberglas siding shall be allowed on the primary building in the residential zoned area of the town. The description of industrial/commercial siding shall include, but is not limited, to corrugated or solid metal or Fiberglas panels, such as pole barn type siding.

Wherefore, be it ordained that the Town of Michiana Shores adopts Ordinance 2009-12 known as Amendment to Title II, Article 2, Chapter 3, Section 14, 2-2-3-14, of the Michiana Shores Municipal Code.

 Adopted on this day of December 2009 by the Town Council Members of the Town of Michiana Shores, Indiana.
